General Installation Terms.
Floors being in a satisfactory condition for the laying of flooring. No allowance has been made for sub-floor preparation other than described above. All surfaces to be covered must be clean, dry and free of other trades in order to complete the installation.
Commerce Carpets is not liable for pre-existing substrate condition. Areas of damage, subsidence, inconsistent materials etc may not be visually detected below existing floor coverings. Additional costs may apply where unforeseen work / materials are required to improve the substrate condition prior to Commerce Carpets installation team undertaking flooring installation(s).
Commerce Carpets is not liable for pre-existing substrate materials. Potentially hazardous materials including asbestos, magnesite etc that are not disclosed to Commerce Carpets prior to Commerce Carpets installation team undertaking flooring installation(s) may require additional treatment(s). Additional costs for repairs, treatments, site costs etc may apply.
Commerce Carpets is not liable for defects that may appear in the installed floor coverings, brought about by - movement in the subfloor, dampness in concrete subfloors or joints in Masonite underlay or insufficient subfloor ventilation.
Commerce Carpets is not liable for third parties that may be recommended by Commerce Carpets to our client(s).
Commerce Carpets is not liable for direct or indirect costs associated with activation of fire sensors and or fire suppression systems. Our installation work generates dust in almost all cases and potentially small amounts of smoke from joining methods where required. The client accepts responsibility for all and any isolation / de-isolation actions associated with these items.
Commerce Carpets is not liable for costs or other impacts beyond its control caused by delays in supply of materials from third party manufacturers, suppliers and or their contractors. Supply lead times provided by Commerce Carpets should be considered indicative unless otherwise guaranteed by Commerce Carpets.
Commerce Carpets will endeavour to take all reasonable precautions to prevent damage to finished surfaces within the installation areas(s). We cannot however accept liability for minor damage that occurs as a result of manipulating large pieces of potentially abrasive flooring products. Examples of abrasive flooring include but are not limited to; broadloom carpet, hessian backed carpets etc.
Commerce Carpets installation team require adequate artificial lighting throughout our installations works. Please note natural lighting is insufficient for most installation works.
Commerce Carpets installation team require safe and consistent supply of 240 volt electrical power throughout our installation works. Potable water is also required unless stated otherwise.
Commerce Carpets installation team require all vulnerable finished surfaces to be protected by cardboard, core flute or similar, robust and sacrificial coverings that allow our team reasonable working room during the installation(s).
Commerce Carpets installation team require all electrical equipment to be disconnected and made safe within the work area(s). This equipment includes but is not limited to; computers, affected network I data cabling, telephones. printers etc. Commerce Carpets is unable to disconnect / connect electrical equipment during any phase of work(s). Commerce Carpets will not be liable for any damage to electrical equipment that occurs during any stage of installation.
13 Commerce Carpets does not accept returns, exchange or credit for materials sold on a
supply only basis.
Commerce Carpets is not liable for removing, replacing, trimming, repositioning doors of any kind. Commerce Carpets is not liable for removing, replacing, trimming, repositioning kick plates/boards or other architectural elements affected by our installation work. The client accepts responsibility for all and any remedial work(s) associated with these items.
In the event the installation area(s) is found unsafe, without sufficient power, water and or lighting, the client accepts additional charges may be applied by Commerce Carpets 'Pty Ltd to recover costs associated with materials storage, freight, duties or any other costs incurred by Commerce Carpets Pty Ltd. The client accepts these charges will be invoiced to them and due nett 7 days from date of invoice.
In the event the client reschedules, postpones or defers a supply and or installation, the client accepts additional charges may be applied by Commerce Carpets Pty Ltd to recover costs associated with materials storage, freight, duties or any other costs incurred by Commerce Carpets Pty Ltd. The client accepts these charges will be invoiced to them and due nett 7 days from date of invoice.
Where listed, product specifications are subject to manufacturing tolerances and may be changed without prior notice. Products may vary in colour from sample and between production lots.
Where Commerce Carpets is requested to provide opinion or advice relating to colour or design selection, the client accepts views expressed are those of the individual and do not constitute design or architectural advice. Such opinion and or advice is provided at no cost without consideration for factors disclosed or not by the client.
Where installations include patterned flooring product(s), Commerce Carpets is not liable for inconsistent wall/joinery intersections or other visual impacts to pattern alignment caused by existing or new structure and or joinery/fumishings.
Where an allowance for remove I replace furnishings is made, all personal effects, breakables, knick knacks etc are to be removed by the client prior to installation commencing. Return placement of furnishings will be approximate only and the client accepts that final furnishings placement is their responsibility. Commerce Carpets is not liable for accidental damage.
No work request, instruction or directive are to be made directly to our installation team(s) and all such related communications must be directed to the Commerce Carpets Project Manager in the first instance.
Unless slated, no allowance has been made for cleaning, vacuuming or protection of carpeting or vinyl.
Unless stated, all work(s) to be completed during normal business hours.
Unless stated, no allowance has been made for the removal or disposal of any existing floor coverings.
Unless stated; all installation work carried out by Commerce Carpets is covered by a workmanship warranty for a period of fifty two weeks from date of installation. Please refer to Commerce Carpets Workmanship Warranty Statement.
Unless stated within the work scope, no allowance for expansion joints has been made. Where expansion joints are uncovered, additional costs may apply to complete a warrantable installation.
Unless stated, the location of joins will be at Commerce Carpets discretion. Changes requested by the client or the clients representative(s) may attract additional cost.
Unless stated, no allowance has been made in our quotation for retention amount(s) to be withheld.
Unless stated, no allowance for administrative costs associated with Building Work Contracts for projects below $ 10,000.00 (ex GST) has been made. Where the client(s) require contracts of this"nature, the client agrees to additional costs in relation to preparation of Building Work Contracts by Commerce Carpets.
Workers Compensation, Public Liability & Contractors Risk insurances are held for 'all work carried out by Commerce Carpets Pty Ltd in New South Wales.
Upon receipt of a purchase order, Commerce Carpets shall require a deposit being 50% of the total contract sum, with the balance payable on completion of the installation. Terms of payment will be nett 7 days from date of invoice.
Where Commerce Carpets is requested to purchase indent or custom manufactured materials, Commerce Carpets shall require a minimum deposit being 75% of the total contract sum, with the balance payable on completion of the installation. Terms of payment will be nett 7 days from date of invoice.
Where Commerce Carpets provides product samples, the client agrees to pay a deposit of $100.00 (ex GST) to ensure the timely return of product samples in good order.
A Commerce Carpets Pre-installation checklist may be required to confirm a scheduled installation.
This quotation is subject to a site inspection & measurement to confirm physical site measurements agree with the DWG, plan and or dimensions provided.
Where relevant the client shall be bound by the Building & Construction Industry Security of Payment Act 1999.
